Description
Description of the Lawsuit – Premarin is a conjugated estrogens product prescribed by doctors to relieve the symptoms associated with menopause and to prevent osteoporosis in postmenopausal women. Plaintiff alleges that the manufacturers, Wyeth-Ayerst Laboratories, Inc. and American Home Products Corporation, violated California’s antitrust and unfair competition laws by engaging in anti-competitive and exclusionary conduct that blocked consumer access to Cenestin, which was an alternative to Premarin. Plaintiff does not challenge the safety or effectiveness of Premarin.
“Class Member” Description – The proposed “Class” includes:
- Consumers and Third-Party Payors of Premarin.
- Consumer plaintiffs are individuals who paid for some or the entire price of Premarin in California at any time since March 24, 1999.
- Third-Party Payor plaintiffs, such as health insurers, union health and welfare benefit plans and any assignees, that paid for or reimbursed for all or part of the cost of a member’s Premarin® prescription in California since March 24, 1999.
Not included in the “Class” are all persons who obtained Premarin® through the MediCal Prescription Drug Program, the defendants (along with their parents, subsidiaries, or affiliates), all governmental entities, and all persons or entities that purchased Premarin® directly from the defendants or for purposes of resale. Consumers and Third-Party Payors who suffered no economic loss as a result of allegedly anticompetitive conduct by Wyeth are not included in the class.
To remain a “Class Member” you need not do anything at this time – As a Class Member, you will be bound by all orders and judgments of the Court. To Exclude yourself from the “Class” – If you are a “Class Member” and want to be excluded from the Class, you must mail a signed letter asking to be excluded to: Premarin Claims Exclusions, P.O. Box 24634, West Palm Beach, FL 33416. Include your name, the name of the person or entity seeking exclusion, an address and telephone number. All exclusion requests must be postmarked by October 31, 2005.

Premarin is used for the treatment of menopausal symptoms including night sweating, hot flashes, dryness of the vagina, burning of the vagina and vaginal irritation. Common side effects associated with Premarin include mild nausea, bloating, stomach cramping, breast pain, tenderness or swelling.
